1. Overview
1.1 These Terms govern your use of the Converta website and service at converta.com.au (the "Service"). By submitting an enquiry or otherwise using the Service, you confirm you have read, understood and agree to these Terms and our Customer Privacy Policy. If you do not agree, do not use the Service.
1.2 You must be at least 18 years old to use the Service.
2. What Converta Does
2.1 Converta operates a platform that connects individuals seeking services ("you") with independent third-party professionals who provide those services ("Professionals"). The Service is provided to you free of charge.
2.2 The Service may connect you with one or more Professionals whose services are relevant to your needs.
3. Facilitator Only
3.1 Converta is a facilitator of introductions only. We are not a party to any contract, service or transaction between you and a Professional. Any service you receive is provided by the Professional under a separate arrangement between you and them, not by Converta.
3.2 We do not provide the services offered by Professionals, do not supervise or control Professionals, and do not guarantee the availability, quality, suitability, licensing, conduct or outcome of any Professional. It is your sole responsibility to evaluate any Professional and decide whether to engage them.
4. Verification and Matching
4.1 When you submit an enquiry, we verify your phone number by SMS one-time passcode and may carry out an internal check to confirm the enquiry is genuine. We may reject or remove an enquiry where contact details are invalid, the enquiry appears fraudulent, or it falls outside our operating criteria.
4.2 Once verified, your enquiry may be shared with a limited number of Professionals relevant to your needs, or with a single Professional on an exclusive basis. You may be contacted by those Professionals directly.
4.3 Your enquiry may also be shared with trusted partners who may be able to assist you, as described in our Customer Privacy Policy.
4.4 We do not guarantee that your enquiry will be matched, that any Professional will contact you, or that any Professional will agree to provide services to you.
4.5 Converta may receive fees, commissions or other benefits from Professionals or partners in connection with introductions made through the Service. The Service always remains free to you.
5. How Professionals Access Your Enquiry
5.1 Professionals access enquiries based on matching criteria including their service category, operating regions and preferences.
5.2 The timing and order in which Professionals can access your enquiry may be influenced by commercial arrangements between Converta and Professionals. These arrangements do not involve Converta assessing or endorsing the quality of any Professional, and the choice of whether to engage any Professional always remains yours.
6. No Endorsement or Vetting Guarantee
6.1 Where we describe Professionals as verified, vetted or similar, this refers only to limited checks we may carry out. We do not warrant the accuracy of information provided by any Professional or that any Professional holds current licensing or authorisation. Any such checks are not an endorsement or recommendation.
6.2 Before engaging any Professional, you should carry out your own checks, including confirming that they hold any licence, registration or authorisation required for the services you are seeking. Most Australian professions maintain a public register, and the relevant industry regulator can confirm whether a person or business is currently licensed. You should also satisfy yourself as to their experience, fees and suitability, and read any agreement they ask you to sign.
6.3 If you have concerns about a Professional you have been connected with, you may report them to Converta at ben@converta.com.au. We may investigate, restrict or remove that Professional from the Service, but we are not obliged to take any particular action. Reporting a Professional does not create any duty of care on Converta to you or to any other person, does not make Converta responsible for that Professional's conduct, and does not affect your rights against that Professional directly.
7. Communications
7.1 By submitting your enquiry, you consent to being contacted by Converta and by Professionals who have received your enquiry, by phone, SMS or email, in relation to your enquiry. This includes introductions and messages sent through the Service on behalf of Professionals, and service updates from Converta.
7.2 You may opt out of non-essential communications at any time. Opting out will not affect communications necessary to deliver the Service in relation to an active enquiry.
7.3 Converta may record calls with you for quality assurance and training purposes. You may decline recording of a particular call by telling us at the time.
8. Your Responsibilities
8.1 You agree to provide accurate information, to use the Service lawfully, and to deal with Professionals in good faith. You must not use the Service for any commercial or business purpose unrelated to a genuine enquiry, or to submit false, misleading or fraudulent enquiries.
8.2 By submitting an enquiry, you confirm that the contact details and other information you provide are your own, or that you are authorised by the person concerned to provide them, and that your enquiry is genuine.
8.3 You are liable for any loss, cost or damage Converta suffers as a result of a false, misleading or fraudulent enquiry you submit, or your submission of another person's details without authority, and Converta may recover those amounts from you.
8.4 You must not use any automated means (including bots, scrapers or crawlers) to access the Service, and must not harvest, extract, copy or compile information from the Service, including Professional profiles or contact information, whether manually or by automated means, for any purpose other than your own genuine enquiry.
9. Reviews, Feedback and Your Content
9.1 Where you leave a review or feedback about a Professional or the Service, it must be honest and based on your own experience, and must not contain unlawful, offensive, defamatory or knowingly false content. We may remove any content that breaches this.
9.2 You grant Converta a non-exclusive, worldwide, royalty-free licence to use, reproduce and display any review or feedback you provide for the purpose of operating and marketing the Service.
10. Liability
10.1 To the maximum extent permitted by law, Converta is not liable for any loss, damage or expense arising from your use of the Service or your dealings with any Professional or third-party service provider we introduce you to, including the performance, conduct, advice, acts or omissions of any of them, or the outcome of any engagement. This applies to any conduct of a Professional, including negligence, poor or incomplete service, delay, unsuitable or incorrect advice, misrepresentation, dishonesty, fraud, and any unlawful conduct. Any dispute regarding services is between you and the relevant provider directly.
10.2 In recognition of the fact that Converta is not a party to any contract between you and a Professional, you release Converta from all claims, demands and damages of every kind, known and unknown, arising out of or in any way connected with any dispute between you and a Professional. This includes any dispute regarding the performance, quality, suitability or outcome of their services, and any negligence, misrepresentation, dishonesty, fraud or unlawful conduct on their part. This release does not apply to any claim that Converta failed to meet its own obligations under these Terms, and does not exclude any right under the Australian Consumer Law that cannot be excluded.
10.3 Nothing in these Terms excludes, restricts or modifies any consumer guarantee or right under the Australian Consumer Law that cannot be excluded. Where liability can be limited, our total liability is limited to resupplying the relevant part of the Service.
11. Termination
11.1 You may stop using the Service at any time. We may restrict or remove your access where you breach these Terms, provide false information, or use the Service unlawfully.
12. Assignment
12.1 Converta may assign, novate or transfer its rights and obligations under these Terms to another entity, including in connection with a sale, restructure or transfer of the Service or Converta's business, without your consent.
13. General
13.1 If any provision of these Terms is held to be illegal, invalid or unenforceable in whole or in part, the remaining provisions continue in full force and effect.
13.2 A failure or delay by Converta to enforce any provision of these Terms is not a waiver of that provision or of Converta's right to enforce it later.
13.3 These Terms do not confer any rights on any person other than you and Converta.
13.4 Clauses 8.3, 8.4, 9.2 and 10 survive your ceasing to use the Service.
13.5 Converta is not liable for any failure or delay in providing the Service caused by events outside its reasonable control, including the failure or degradation of third-party infrastructure, hosting, payment, telecommunications or messaging services, internet outages, natural disasters, government action, or industrial disputes.
14. Changes
14.1 We may update these Terms from time to time. The updated version applies from the date posted, with a revised "Last updated" date. Continued use of the Service constitutes acceptance.
15. Governing Law
15.1 These Terms are governed by the laws of Queensland, Australia, and are subject to the exclusive jurisdiction of the courts of Queensland.
