  1. Introduction

This Privacy Policy explains how Converta Pty Ltd ("Converta", "we", "our", "us") collects, uses, discloses, stores and protects personal information provided by or collected from professionals ("Professionals", "you", "your") who access or use the Converta platform (the "Platform").

Converta is committed to handling personal information in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles ("APPs"). By accessing or using the Platform, you acknowledge that you have read and understood this Privacy Policy. It should be read alongside the Converta Professional Platform Terms & Conditions.

Converta operates a lead generation platform that facilitates introductions between individuals seeking services ("Customers") and independent Professionals who provide those services. Converta is a facilitator of introductions only and is not a party to any service or contract between you and a Customer.

  1. Information We Collect

2.1 Information You Provide

  • Identity and contact information: your name, email address and phone number.

  • Business and licensing information: your business or company name, any licence, registration or authorisation details relevant to the services you provide, and the geographic areas in which you operate.

  • Service preferences: your preferred client profile and the types of leads you wish to receive.

2.2 Information Collected Automatically

  • Device and browser information: device type, operating system, browser type and version.

  • Usage information: pages viewed, features accessed, leads browsed, leads unlocked, login history, time spent on the Platform, and clickstream data.

  • Screen recordings and session data: we may record screen interactions and session replays to analyse use and improve the Platform.

  • Cookies and similar technologies: we and our service providers may use cookies, pixels and similar tracking technologies to collect usage data and support Platform functionality.

  1. How We Use Your Information

  • Platform operation: to provide, maintain and improve the Platform and its features.

  • Account management: to process your registration, verify your eligibility and any licensing or authorisation, manage your account, and communicate with you about your account.

  • Lead matching: to display relevant leads based on your operating areas, preferences and activity.

  • Payment processing: to process your credit and package purchases through our payment provider.

  • Analytics and improvement: to analyse usage patterns, improve functionality and develop new features, including reviewing screen recordings and session data.

  • Communication: to contact you about your account, Platform updates, new features or matters relevant to your use of the Platform.

  • Marketing: to send you communications about Converta services, promotions or related offerings. You may opt out at any time.

  • Customer communication: we may share certain information about you (such as your name or business name) with matched Customers to facilitate introductions and set expectations before you make contact.

  • Promotional use: we may use your name, business name, testimonials, reviews or feedback for Converta's marketing and promotional purposes.

  • Aggregated insights: we may use general, non-identifying information (such as the number of Professionals in a region) in marketing materials or reports. This will not identify you individually.

  • Legal and compliance: to comply with applicable laws, respond to legal process, enforce our Terms, and protect the rights, property or safety of Converta or others.

  1. Disclosure of Your Information

4.1 Customers

To facilitate matching, we may share limited information about you with Customers, such as your name or business name. We will not share your contact details with Customers without your knowledge.

4.2 Third-Party Service Providers

We engage third-party providers who may access your information only as necessary to perform their functions. These include website hosting and infrastructure, payment processing, analytics and session recording tools, SMS and email communication platforms, and data storage and workflow automation tools.

4.3 Integrated Service Partners

We may partner with third-party companies to offer optional or integrated services connected to the Platform. If you choose to use one of these, we may share your name and contact information with that partner so they can set up and provide the service and analyse your usage of it. Some partners are separate controllers of your data, and their use of your information will be governed by their own privacy policies.

4.4 Business Transfers

In connection with any merger, sale of company assets, financing, acquisition, or transition of service to another provider, or in the event of insolvency, bankruptcy or receivership, your personal information may be disclosed or transferred to a successor or acquirer and their advisors as part of that transaction.

4.5 Legal Requirements

We may disclose your information where required or permitted by law, including to comply with a court order, subpoena, regulatory investigation or other legal process.

  1. Customer Data You Receive

When you unlock or receive a Customer lead, you receive personal information about that Customer. In relation to that information, you act as an independent party responsible for your own compliance with the Privacy Act 1988 (Cth) and the APPs, and with all other laws applicable to your handling of personal information and your communications with Customers, including the Spam Act 2003 (Cth) and Do Not Call Register obligations.

You must only use Customer information for the purpose of contacting and servicing that Customer, must not resell, redistribute or repurpose it, and must honour any opt-out or unsubscribe request. Your obligations in relation to Customer data are set out further in the Converta Professional Platform Terms & Conditions.

  1. Cross-Border Disclosure

Some of our third-party providers are located outside Australia, including in the European Union and the United States. Your personal information may be transferred to, stored in, and processed in those jurisdictions. Where we disclose information overseas, we take reasonable steps to ensure the recipient handles it consistently with the APPs. By using the Platform, you consent to this transfer.

  1. Data Retention

We retain your personal information for as long as reasonably necessary to fulfil the purposes for which it was collected, comply with our legal obligations, resolve disputes, and enforce our agreements. Following account closure, we may retain your information for a reasonable period as required by law or for legitimate business purposes. Where retention is no longer necessary, we will delete or de-identify your information, isolating it from active processing where immediate deletion is not possible. Aggregated or de-identified data may be retained without limitation.

  • Request deletion of your personal information by contacting us at the details in Section 11. We will take reasonable steps to delete it from our active systems, subject to legal or operational requirements.

Converta takes reasonable steps to protect personal information from misuse, interference, loss, and unauthorised access, modification or disclosure. We use commercially available security measures and work with reputable third-party platforms. No method of electronic transmission or storage is completely secure, and we cannot guarantee absolute security.

  1. Cookies and Tracking Technologies

The Platform may use cookies, session recording tools and similar technologies to support functionality, analyse usage and improve the experience. You can manage cookie preferences through your browser settings. Disabling cookies may affect functionality.
